NOTICE IS HEREBY GIVEN to the public and to all interested persons that under the legal authority and jurisdiction of Title 3, Oil and Gas, Subtitles A, B, and C of the Texas Natural Resources Code, Chapters 26, 27 and 29 of the Texas Water Code, and TEX. GOV'T CODE ANN. §§ 2001 et seq. (2011), the RAILROAD COMMISSION OF TEXAS will hold a hearing on FEBRUARY 9, 2012, at 9:00 a.m. at the William B. Travis State Office Building, 1701 N. Congress Avenue, Austin, Texas. This hearing will be conducted in conformity with the TEX. GOV'T CODE ANN. art. §§ 2001 et seq. (2011). The Commission will consider the application of Phere Operating, Inc. for a spacing exception permit under the provisions of 16 Texas Administrative Code §3.37 (Railroad Commission Statewide Rule 37). A copy of the plat filed by the applicant with its drilling permit application is attached to this notice for reference purposes.
Applicant seeks an exception to the lease line spacing requirement(s) of the field rules for the Vicksburg (8750) Field(s), because the proposed well is closer than allowed by the field rules to the external boundary of the pooled unit, being 318 feet to the nearest unit boundary.
Applicant has made application for a recompletion (vertical) permit for Well No. 8, Drummond-Superior Lease, Musquiz, R. Survey, A-59, Jackson County, Texas, being 1.5 miles in a southeast direction from Vanderbilt, Texas.
The location of this well is as follows:
SL: 318 feet from the east north east line and 469 feet from the southwest line of lease.
29300 feet from the northwest line and 24500 feet from the southwest (NE A-74) line of survey.
Field rules for the Vicksburg (8750) Field(s) are:

467 feet from the nearest lease line and 1200 feet between wells on the same lease in the same field and reservoir on 40 acre proration units.
This well is to be drilled to an approximate depth of 8690 feet.
